Epic Oldies Kennel/ Puppy Agreement

1) At least a 25% Deposit is required in order to hold a pup.
2) Deposits are NON REFUNDABLE. If you decide you don’t want the puppy, you forfeit your Deposit. If something happens to said puppy (death, false pregnancy, buyer doesn’t like it, or wants to wait on another litter) you may choose from the next AVAILABLE litter. (Not the next litter due, unless buyer agrees to take a choice behind whoever has a deposit on said litter.)
3) Choice of puppy is determined on a first come (deposit received) first to choose basis. Buyer will be supplied with photos of available pups when pups are 1 week old or older. The buyer has up until the pups are 3 weeks old to choose, they will be notified when they need to choose. Buyer will be given 48 hours to decide on the pup. After 48 hours, if buyer has not chosen, he/she forfeits their choice until all others with deposits have chosen.
4) ALL shipping costs are the buyer’s responsibility. Buyer should be aware that weather and holidays may make it difficult to ship on time.
5) We guarantee the dogges/pups will be healthy and vet certified upon arrival. We however do not offer this animal as a breeding animal nor do we promise this to be a top show prospect, if you [the buyer] decide that you want to breed or show your dogge this is a decision that you have to make, we do not guarantee it to be such. You must have your dogge/pup vet checked within 2 business days of arrival and if any problems are discovered we must receive a written notice by your Veterinarian.
6) All of our puppies are guaranteed against genetic defects for 1 year, if a problem is found the dogge must be returned along with notice from your Veterinarian. Buyer may choose a puppy from the next available litter.
7) Buyer must register said dogge or pup with the Victorian Bulldogge Association within 6 months of purchase. **Said dogge or pup MUST NOT be registered with ANY OTHER ORGANIZATION/REGISTRY other than the VBA [Victorian Bulldogge Association] if it is recognized as an Olde Victorian Bulldogge. Doing so is in breach of this contract and buyer acknowledges that said dogge or pup must be returned to the seller [at the buyers expense] with no moneys refunded to the buyer. **
8) Buyer will also be responsible for any legal fees and travel expenses that are incurred by the seller if the buyer is in default of this contract.
9) Any legal proceedings must take place in county where seller lives.
10) In such a case that seller discovers the dogge being sold is mistreated in any way i.e. dog fighting, neglect or abuse seller retains the right to recover said dogge and place it with a responsible pet owner, with no refund given to buyer and all expenses will be the sole responsibility of buyer.
*** If for any reason you can no longer care for the dogge Epic Oldies Kennel will take it back and place it with a good home, but we will not refund money.
Both BUYER and SELLER acknowledge that no representations verbal or implied, have been made with regard to said bulldogge future abilities. If Michael Baber cannot reach the purchaser by the above stated contact methods, the buyer will be removed from the list and the deposit kept by the kennel. We highly recommend that purchaser notify Michael Baber with any change in contact information and remain in contact with us on a regular basis.

This is a binding agreement, and if the buyer breaches this contract the deposit is retained by Michael Baber. The buyer understands by signing this contract that the DEPOSIT IS NON-REFUNDABLE. The buyer also understands and agrees that the final payment is due before the puppy is 8 weeks old. By signing this agreement, you agree to all of the terms and conditions listed above.
